Article 4.4.6 in the Volume I User Guide discusses Force Account reporting. Daily report formats are often established at the pre-job meeting.

Article 4.4.6.5 references Exhibit #7 as a sample Daily Force Account Report. This is on the MMCD website at https://www.mmcd.net/documents/forms-and-templates/

The Site Inspector or CA must sign off on the quantities submitted on the forms. Article 4.4.6.1 outlines the process if there is disagreement. Payment for disputed items can be resolved by the CA, or failing that, through the Dispute process. However, it is deemed important to have evidence of the quantities stipulated on the forms, for later reference.

Seeking clarification of clauses 31 11 01 3.3 and 3.4, clearing and grubbing.

A disagreement arose with a contractor regarding the interpretation of clauses 31 11 01 - 3.3 and 3.4. We believe clearing and grubbing of an existing tree stump includes complete removal (uprooting) of the stump not less than 200mm below existing ground. The Contractor believes that the work includes only the grinding of the stump down to 200mm below grade. They then buried the remainder of the stump underground. Unfortunately, the roots started growing in a private driveway shortly after and causing damages. Can you please clarify if the original intent of the clauses were to completely uproot the stump, or to partially leave the stump behind?

Clearing refers to the removal of all vegetation, while grubbing is the removal of roots that may remain in the soil. This includes the removal of all logs, brush, and debris, as well as grinding and removal of stumps.

Is a Change Order required for Extra Work?

The Contract Administrator is the interpreter of the Contract Documents, and the judge both parties to the Contract (GC 3.6.1). However, there are references in the General Conditions of the MMCD to Extra Work. Extra Work is defined in GC 7.1.3. Extra Work is covered in GC 8.0. The Contractor is invited to perform Extra Work by issuing a Contemplated Change Order or Field Memo.(GC 8.1.1).

Are eDocuments automatically updated when supplementaries are released?

This is definitely something which would be useful and we had considered. However, the MMCDA Document is a legal document which has specifications adopted by municipalities and incorporated into their bylaws. For this reason, all supplementaries are held seperate from the original document itself so that in referencing the specifications, if a municipality or district has not approved the supplementaries, the original specifications are not "missing" from the document.

To answer your question, the supplementaries must be printed out and incorporated and a city, municipality, company, etc. must decide which supplementaries to adopt. The MMCD makes every effort to notify members on our mailing list when new supplementaries are released.

I found an error in one of MMCD's documents. How do I report it?

If you have noticed an error in one of documents or have suggestions for improvement, please do not hesitate to pass them along to us. In order to expedite the review process for our Board and Committees, please be sure to include the following when you send us an email to admin@mmcd.net:

Your name and contact information (including email & phone number)
The edition that you are submitting a supplementary for (Gold, Platinum)
The volume that the error, correction or improvement currently resides in
The exact reference number, section or page you wish to report a correction for.
A detailed account of your suggestions.

Please be aware that although we review and consider all submissions, depending on their validity determined by the Board or appropriate Committees, they may or may not be incorporated as a supplementary. We appreciate all suggestions in an effort to make the MMCD documents better.

What is the MMCD? Which volume of MMCD should I purchase?

I'm a bit confused, I thought this would be something specific to the project we're bidding on, but looks like it is more of a general guideline? Would we need to buy both Volume 1 and Volume 2?

The MMCD documents are the basis for many construction contracts in BC. They replace the “boiler plate” of some construction contracts. The owner may use the MMCD to manage the bidding process and the contract administration process. However, the tender package will usually have separate contract documents for the specific design package for the project; and supplementary clauses with can modify the standard clauses, drawings and specifications in the MMCD. Many contractors have copies of the MMCD in order to:

familiarize themselves with the general conditions and contract terms used by many municipalities in BC
to respond to a bid opportunity which references the MMCD, but which has a tender package with specific contract drawings and supplementary clauses.

The advantages of using the MMCD is that the standard contract forms procedures and rules are well known to bidders and owners; and the potential bidder can concentrate on the unique portions of the contract, the drawings, supplementary specifications and supplementary clauses if any.

Volume II contains the standard contract provisions; Volume I is a “User Guide” that helps to navigate and understand the contents of Volume I. Both volumes are available in electronic form, with a search function.
